If you have been arrested for a second or third DUI, you are probably wondering if you are going to jail. There are ways an experienced DUI can help you avoid going to county jail or state prison. One of the alternative DUI sentences is a residential treatment program. In Florida, many counties will allow you to complete an in-house residential treatment program instead of going to jail.
These programs are typically 28 days. During that time you would remain in the facility and get help. When you successfully complete that four-week program, that gives us ammunition to take to the prosecutor. It allows us to present a case for you by saying you have been in treatment for almost a month, you have gone through four weeks of random testing for alcohol and you have undergone counseling. Many times this allows us to keep our clients out of jail if they complete this residential treatment program.
Another alternative to a jail sentence for a DUI is called the S.C.R.A.M. device. This device monitors the alcohol content in your body 24 hours a day by measuring the alcohol level in your skin. It is worn around your ankle. If you combine this S.C.R.A.M. monitor with a treatment program we have the chance to present an option to the prosecutor that does not include a jail sentence.
