There is no bigger hot spot for the issues surrounding breath tests in DUI cases than Sarasota, Florida. Defense Attorneys in this part of the state have had great success in having 100’s of breath tests excluded due to the Intoxilyzer machines utilized in the area. It has been very frustrating for prosecutors in these DUI cases. With so much information coming from this part of the state it seemed to make perfect sense that Sarasota County Judge Kimberly Carlton Bonner was selected to spend the next three years leading the state’s DUI Adjudication Lab, according to the Sarasota Herald Tribune’s Todd Ruger.
The lab is set up to educate Florida judges about DUI cases. Included is an intensive week-long course with judges that examines all issues related to traffic DUI cases. For the first time that course took place in Sarasota and among the issues discussed were jury selection, breathalyzer testing, traffic stops, search and seizure and DUI sentencing.
